Are there any time limits to making a claim?Yes, the time limits differ within each branch of Compensation Law but for Motor Vehicle Accident Claims the accident must be reported to the Police within 28 days of the accident and the Personal Injury Claim Form must be lodged with the CTP Insurer of the at-fault driver within 6 months of the accident.
I am not sure if my injuries will be permanent; should I contact a Lawyer?Yes, your injuries will need to be properly assessed by a medical practitioner. Often the latent effects of an injury do not manifest themselves until 6-12 months times. By contacting us we will ensure your medical bills are paid up to the point of liability.
I am now retired but my hearing loss has continued to cause me problems. What should I do?Contact your lawyer firstly who will advise you to do a hearing test with an Audiologist. Your rights differ based on your binaural hearing loss (combination of hearing loss in both ears). You may be entitled to hearing aids and/or lump sum payment. If you are still working, your claim will be against your current employer. If you are retired, your claim will be against your last noisy employer.
What should I do if I am injured in a public place?You should contact the responsible party as soon as possible, being the store owner, centre management, local council or authority. It is also recommended that you take photographs of the incident site for evidentiary purposes. Seek medical treatment as soon as possible preceding the accident to ensure you do not injure yourself further, then seek legal advice so that you are aware of your rights and entitlements.
Do Motor Vehicle Accident (MVA) Claims, Workers Compensation Claims, or Public Liability Claims take long until they are completed?If your matter has reasonable prospects of success and we have advised you accordingly, your matter will likely take between 12- 24 months before completion. If the matter is to go to Court and/or CARS, add a further 6-18 months. There are a number of variables that affect the timeline, contact our office to discuss.
